Welcome to Cincinnati Stairlift Sales (“we,” “us,” or “our”). These Terms of Use govern your access to and use of our website located at cincinnatistairliftsales.com (the “Site”). By accessing or using the Site, you agree to be bound by these Terms of Use. If you do not agree, do not use the Site.
1. WHAT THE SITE DOES
Cincinnati Stairlift Sales is a free online directory that connects homeowners in the greater Cincinnati, Ohio area with local stairlift installation companies. We collect and display information about installers, including their service areas, customer reviews, and contact information. We do not perform installations ourselves, and we do not sell, install, or service stairlifts. We are not a party to any agreement you may enter into with an installer.
2. THE QUOTE REQUEST FORM
By submitting a quote request through the Site, you understand and agree that:
– You are requesting to be contacted by up to three (3) participating stairlift installation companies in your area regarding your project.
– You will be contacted by phone, email, text message (SMS), or any combination of these methods.
– The companies that contact you are independent businesses. We are not the installer, and we do not guarantee the quality, legality, suitability, or outcome of their work.
– Submitting a request does not guarantee that you will receive any quote, nor does it create a contract with any installer.
3. CONSENT TO BE CONTACTED (TCPA / TELEMARKETING COMPLIANCE)
By submitting a quote request, you expressly consent to be contacted by up to three (3) participating installation companies and their agents or representatives regarding your stairlift project, by telephone (including calls that may use prerecorded or artificial voice messages), email, and/or text/SMS messages, at the contact information you provided. You understand that:
– Standard message and data rates may apply for any SMS/text messages.
– You may revoke this consent at any time by replying STOP to a text message, by telling the caller to stop calling, or by emailing us at info@cincinnatistairliftsales.com with “do not call” in the subject line.
– We and the participating installers will use your contact information only to follow up on your quote request, not for unrelated marketing.
4. CALL RECORDING
For quality assurance, training, and accuracy of reporting, calls between you and the participating installers (or their representatives) may be recorded. By using the Site and submitting a quote request, you expressly consent to such recording. Recordings are retained by the recording party in accordance with its own privacy practices and applicable law. We are not responsible for the recording or retention practices of any installer.
5. NO ENDORSEMENT; INFORMATION ACCURACY
– Reviews, ratings, and other information displayed on the Site are sourced from third parties (notably Google) and reflect the opinions of individual customers, not our opinions.
– We do not endorse, warrant, or guarantee any specific installer. We do not warrant the accuracy of any installer profile, rating, review, or service description.
– You are responsible for verifying any installer’s licensing, insurance, references, and suitability for your specific project before signing a contract with or paying any installer.
6. NO PROFESSIONAL ADVICE
Content on the Site (including the FAQ, buyer’s guide, installer Q&A, and any other editorial content) is for general informational purposes only. It does not constitute legal, financial, medical, or professional advice. Always consult a qualified professional for decisions specific to your situation.
7. USER CONDUCT
You agree not to:
– Submit false, misleading, or fraudulent information in any form
– Use the Site for any illegal purpose or in violation of any applicable law
– Use bots, scrapers, or other automated tools to access or use the Site
– Attempt to interfere with the Site’s security or operation
– Solicit installers for goods or services unrelated to the original quote request
8. INTELLECTUAL PROPERTY
The Site, including its design, code, text, graphics, logos, and other original content (excluding installer profiles, reviews, and Q&A submitted by installers or third parties), is owned by us and is protected by U.S. and international copyright and trademark law. You may not copy, reproduce, republish, distribute, or create derivative works from any of our original content without our prior written consent.
9. THIRD-PARTY LINKS AND SERVICES
The Site may contain links to third-party websites (including installer websites). We do not control and are not responsible for the content, privacy policies, or business practices of any third-party site or service.
10. DISCLAIMER OF WARRANTIES
THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
11. LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY LAW, CINCINNATI STAIRLIFT SALES AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE OR YOUR INABILITY TO USE THE SITE, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, REGARDLESS OF THE LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).
12. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Cincinnati Stairlift Sales and its officers, directors, employees, and agents from and against any claims, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to your use of the Site, your violation of these Terms, or your violation of any applicable law or the rights of any third party.
13. MODIFICATIONS
We reserve the right to modify these Terms at any time, in our sole discretion. The “Last updated” date at the top of these Terms will reflect the most recent changes. Your continued use of the Site after any modification constitutes your acceptance of the new Terms. If you do not agree to a modification, you must stop using the Site.
14. GOVERNING LAW AND VENUE
These Terms are governed by the laws of the State of Ohio, without regard to its conflict-of-law provisions. You agree that any legal action or proceeding arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Clermont County, Ohio, and you consent to the personal jurisdiction of those courts.
15. SEVERABILITY
If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permissible and the remaining provisions shall remain in full force and effect.
